Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and Pia Industries LLC ("we," "us," or "our") governing your use of the Big Stretch mobile application (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

By accessing or using Big Stretch, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are using the App on behalf of a minor, you accept these Terms on their behalf and are responsible for their use of the App.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on any Apple device that you own or control, solely for your personal, non-commercial use, subject to these Terms and the Apple App Store Terms of Service.

This license does not allow you to:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse-engineer, decompile, or disassemble the App or attempt to extract its source code
• Remove, alter, or obscure any proprietary notices within the App
• Use the App for any commercial purpose or for the benefit of any third party
• Transfer your license to another person or "mirror" the App on any other server

3. Subscriptions and Payments

Big Stretch offers both free and premium features. Access to premium features requires a paid subscription or one-time lifetime purchase.

• Subscription Plans: We offer Monthly, Annual, and Lifetime purchase options. Current pricing is displayed within the App and may vary by region.
• Free Trial: New users may be eligible for a free 7-day trial of premium features. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged.
• Auto-Renewal: Monthly and Annual subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.
• Cancellation: You may cancel your subscription at any time through your Apple ID account settings (Settings > Apple ID > Subscriptions). Cancellation takes effect at the end of the current billing period. No partial refunds are provided.
• Payment Processing: All payments are processed by Apple through the App Store. We do not collect, store, or have access to your payment card information. Refund requests must be directed to Apple.
• Price Changes: We may change subscription pricing at any time. Price changes for existing subscribers will take effect at the start of the next billing period following notice.

4. User Content

You retain ownership of all data you enter into the App, including pet profiles, activity logs, and photos ("User Content"). All User Content is stored locally on your device. We do not access, collect, or store your User Content on any server.

You are solely responsible for your User Content, including maintaining any backups. Because all data is stored on-device, deleting the App or resetting your device will permanently remove your User Content. We cannot recover deleted data.

5. Prohibited Uses

You agree not to use the App to:

• Violate any applicable local, state, national, or international law or regulation
• Transmit any viruses, malware, or other harmful code
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt the App or any related systems
• Use the App in any manner that could disable, overburden, or impair its functionality
• Use automated scripts, bots, or similar tools to interact with the App
• Impersonate or misrepresent your affiliation with any person or entity

6. Intellectual Property

The App, including its design, user interface, graphics, icons, training content, text, and all related intellectual property, is owned by Pia Industries LLC and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right, title, or interest in the App beyond the limited license in Section 2.

"Big Stretch" and the Big Stretch logo are trademarks of Pia Industries LLC. You may not use these marks without our prior written consent.

7. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

Not Veterinary Advice: Big Stretch is a training and activity tracking tool. It is not a substitute for professional veterinary advice, diagnosis, or treatment. The training guidance, schedules, and recommendations provided in the App are for informational purposes only. Always consult a qualified veterinarian or certified dog trainer for medical concerns or behavioral issues with your pet.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PIA INDUSTRIES LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO:

• Your use of or inability to use the App
• Any errors, inaccuracies, or omissions in the App's content or training guidance
• Loss of locally stored data due to device failure, App deletion, or any other cause
• Any unauthorized access to or alteration of your device data
• Any actions taken based on training recommendations in the App

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify, defend, and hold harmless Pia Industries LLC from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the App or your violation of these Terms.

10. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your license to use the App will immediately cease.

You may terminate these Terms at any time by deleting the App from your device and canceling any active subscription through your Apple ID settings. Sections 6, 7, 8, 9, and 11 survive termination.

11. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law principles. Any dispute arising from or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Effective date" at the top of this page and may provide notice within the App. Your continued use of Big Stretch after any modifications constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pia Industries LLC regarding your use of the App and supersede any prior agreements.
